All Homes Pty Ltd reserves the right to modify these terms at any time at its discretion.
All Homes Pty Ltd provides space for the publication of content, including images, on the website for the purpose of users advertising for sale any item, other than real estate or browsing advertisements placed by other users.
The content on the website is the subject of copyright and is owned or licensed by All Homes Pty Ltd. The content is provided for the internal or private use of users. You agree that you will not without the consent of All Homes Pty Ltd:
You release All Homes Pty Ltd, to the extent permitted by law, from claims regarding use of data or information available on the website. All Homes Pty Ltd will not be accountable for incidental or consequential damages ensuing from use of the data or information on the website. All Homes Pty Ltd's liability for breach of any implied warranty or condition that cannot be excluded is limited, at the option of All Homes Pty Ltd, to either the re-supply of services or payment of the cost of re-supply of services.

Accordingly, All Homes Pty Ltd makes no guarantees, undertakings or warranties regarding the accuracy, truth, comprehensiveness or currency of information contained in advertisements, the suitability, quality, safety, merchantability, fitness for any particular purpose or legality of any of the items advertised for sale on the website, or the ability or capacity for sellers or buyers to complete or enforce a transaction regarding an item advertised for sale on the website.
On application by you, All Homes Pty Ltd will, subject to these terms and conditions, publish an advertisement for the sale of an item, other than real estate. You are responsible for any content of any advertisement you submit for publication on the website.
Advertisements consisting of text only will be published for free. If you wish to publish an image with your advertisement, All Homes Pty Ltd will charge you a fee of AUD$15.00 (including GST) per image.
Your advertisement will remain on the website for an initial period of 60 days. After your advertisement has been on the website for 52 days, All Homes Pty Ltd will send you an e-mail inviting you to renew your advertisement at the end of the initial period of 60 day by notifying All Homes Pty Ltd in the manner specified in the e-mail. Advertisements consisting of text only may be renewed for one further period of 60 days. Advertisements which include one or more images may be renewed for up to 5 further periods of 60 days each for no extra charge.
In submitting content to All Homes Pty Ltd for publication on the website, you:
You agree not to alter or amend an advertisement to describe or offer for sale an item which is different from the item originally advertised.
All Homes Pty Ltd reserves the right to remove from the website or to refuse to place on the website, at its discretion:
In submitting content to All Homes Pty Ltd for publication on the website, you indemnify All Homes Pty Ltd, its officers, employees and agents, against all liabilities, claims, demands, damages, costs and penalties suffered by All Homes Pty Ltd as a result of your breach of the terms and conditions.
All Homes Pty Ltd will provide a refund if you have been charged for publication of an image where as a result of an error by the officers, employees or agents of All Homes Pty Ltd, you have been charged an incorrect amount. All Homes Pty Ltd will provide refunds in other circumstances at its sole discretion.
All Homes Pty Ltd will not provide refunds in the following circumstances:

If you operate a business, you may list your business in the Business Directory for a fee of $229.00 (including GST) for a 12 month period. The listing will be placed in one category chosen by you. You may list your business in more than one category for a fee of $69.00 (including GST) for each additional category.
Applications for inclusion of a business in the Business Directory can be made by completing the form available at http://www.allhomes.com.au/ah/act/research/business-directory-application/download and returning it to All Homes Pty Ltd with payment of the applicable fee.
If you have a Business Directory listing, you must include in your listing your name or a registered business name if trading under a business name, a phone number and a physical address.
The following terms and conditions apply, in addition to the other terms and conditions set out above, if All Homes Pty Ltd enters into a written dealer membership agreement with you.
All Homes Pty Ltd will grant you access to the dealers portal which allows you to manage all of your advertisements.
You will be provided with a user id and password for each employee nominated by you. You must take all reasonable steps to ensure the user ids and passwords issued to you and your employees remain confidential and secure at all times. You must change your password immediately upon becoming aware that the security and confidentiality of your password has been compromised.
You accept liability for any unauthorised use of any user id or password issued to you and your employees except where that unauthorised use results from negligence or fraud on the part of All Homes Pty Ltd or its employees, officers and agents.
You must maintain a listing in the Business Directory which includes the user's logo. You must ensure that the information contained in your Business directory listing is kept up to date.
You will be entitled to place an unlimited number of advertisements on allclassifieds.com.au each month for a monthly fee of $199.00 (including GST). All Homes Pty Ltd will issue you with a tax invoice for the monthly fee on the last day of the calendar month, payable within 7 days of the date of the invoice.
For each advertisement placed by you, you must:
You must include the allclassifieds.com.au logo as provided by All Homes Pty Ltd from time to time on all advertising material published by you.
If your business ceases to operate or changes details you must notify All Homes Pty Ltd within 48 hours of the changes coming into effect.
You must only place advertisements using the dealers portal for items for sale through the business listed in the Business Directory.
Without limitation to any other rights, either party may terminate the dealer membership agreement on one month's notice.
All Homes Pty Ltd may terminate the dealer membership agreement immediately and without notice to you, including removing any advertisements currently listed, if you are in breach of any term of the dealer membership agreement, including failing to pay any amount invoiced by the due date.
Upon termination of the dealer membership agreement, each party remains liable to pay any fee owing to the other for services rendered prior to termination taking effect.
